TITRE I — DISPOSITIONS GÉNÉRALES
Article 1 — Dénomination Il est créé, entre les personnes adhérant aux présents statuts, une association dénommée Association de la Diaspora Tchadienne, en abrégé ADT.
Article 2 — Nature L'ADT est une institution apolitique, non religieuse, non tribale et non clanique, ouverte à toute personne de nationalité ou d'origine tchadienne établie hors du territoire national, sans distinction d'opinion politique, de confession, d'origine régionale ou communautaire.
Article 3 — Objet L'ADT a pour objet de :
- fédérer les Tchadiens et personnes d'origine tchadienne résidant à l'étranger autour d'une structure représentative, crédible et transparente ;
- contribuer, par ses compétences, ses ressources et ses réseaux, au développement économique, social, culturel et humain du Tchad ;
- défendre les intérêts moraux et matériels de ses membres dans leurs pays de résidence ;
- promouvoir la paix, la cohésion sociale et la solidarité entre tous les Tchadiens, sans distinction aucune.
Article 5 — Durée L'ADT est constituée pour une durée illimitée.
TITRE II — LES MEMBRES
Article 6 — Adhésion Peut adhérer à l'ADT toute personne de nationalité tchadienne ou d'origine tchadienne, résidant hors du Tchad, acceptant sans réserve les présents statuts et le règlement intérieur, et à jour de ses cotisations.
Article 7 — Droits des membres Tout membre a le droit de participer aux Assemblées générales, d'y prendre la parole dans les conditions fixées par le règlement intérieur, de voter, d'être candidat aux instances de l'Association, et d'être informé de la gestion de l'ADT.
Article 8 — Devoirs des membres Tout membre s'engage à respecter les présents statuts, à s'acquitter de sa cotisation, à observer la neutralité politique, religieuse, tribale et clanique de l'Association, et à s'abstenir de tout comportement portant atteinte à l'image ou à l'unité de l'ADT.
Article 9 — Perte de la qualité de membre La qualité de membre se perd par démission, décès, ou exclusion prononcée par le Conseil des Sages pour manquement grave aux présents statuts, dans les conditions précisées par le règlement intérieur.
TITRE III — LES ORGANES DE L'ASSOCIATION
L'ADT est structurée autour de trois organes principaux :
- l'Assemblée Générale, organe souverain ;
- le Conseil des Sages de la Diaspora Tchadienne (CSDT), organe législatif et de contrôle ;
- le Bureau Central de la Diaspora Tchadienne (BCDT), organe exécutif.
Chapitre 1 — L'Assemblée Générale
Article 10 — Composition et rôle L'Assemblée Générale réunit l'ensemble des membres de l'ADT. Elle est l'organe souverain de l'Association. Elle élit ou valide la composition des instances dirigeantes, adopte et modifie les statuts et le règlement intérieur, et se prononce sur toute question qui lui est soumise par le Conseil des Sages ou le Bureau Central.
Article 11 — Fonctionnement Les modalités de convocation, de quorum et de vote de l'Assemblée Générale sont précisées dans le règlement intérieur.
Chapitre 2 — Le Conseil des Sages de la Diaspora Tchadienne (CSDT)
Article 12 — Rôle Le Conseil des Sages est l'organe législatif de l'ADT. Il exerce le contrôle du Bureau Central, valide ses principales décisions financières et ses projets, arbitre les différends internes, et veille au respect des présents statuts et des valeurs fondatrices de l'Association.
Article 13 — Composition de base Le Conseil des Sages est composé, dans sa formation de base, de cinq membres :
- un Président ;
- un Coordinateur ;
- un Chargé de contrôle et de suivi des activités et des finances ;
- un Porte-parole ;
- un Conseiller chargé de mission.
Article 14 — Constitution initiale Lors de la mise en place initiale du Conseil des Sages :
- Un Président est désigné ou élu par l'Assemblée Générale de la Diaspora, le jour même de l'élection du Bureau Central.
- Le Président ainsi désigné ou élu compose, en toute confiance, le reste de son bureau, qu'il soumet ensuite à la validation d'une Assemblée Générale.
- Le Président du Conseil des Sages détermine la date de cette Assemblée Générale de validation.
Chapitre 3 — Le Bureau Central de la Diaspora Tchadienne (BCDT)
Article 16 — Rôle Le Bureau Central est l'organe exécutif de l'ADT. Il met en œuvre les décisions de l'Assemblée Générale, gère les affaires courantes de l'Association, collecte les cotisations, coordonne les Bureaux exécutifs nationaux et supervise les Services spécialisés.
Article 17 — Composition Le Bureau Central est composé de cinq (5) membres :
- un Coordinateur ;
- un Assistant au Coordinateur ;
- un Chargé des finances ;
- un Chargé des finances adjoint ;
- un Chargé de communication.
Article 18 — Mandat Le mandat du Bureau Central est de deux (2) années, renouvelable une seule fois, avec l'accord du Conseil des Sages.
Article 19 — Reconnaissance des Bureaux exécutifs nationaux Le Bureau Central reconnaît les Bureaux exécutifs de la Diaspora déjà existants dans les différents pays de résidence. Dans tout pays où un tel Bureau n'existe pas, le Bureau Central est habilité à en susciter la création, selon les modalités fixées par le règlement intérieur.
Chapitre 4 — Les Services spécialisés
Article 20 — Création et rattachement Le Conseil des Sages met en place des Services spécialisés destinés à renforcer l'action du Bureau Central. Ces Services sont placés sous la responsabilité directe du Bureau Central.
Article 21 — Liste des Services Sont notamment créés :
- le Service chargé des réfugiés ;
- le Service juridique ;
- le Service chargé des projets ;
- le Service social ;
- tout autre Service jugé nécessaire, créé par le Conseil des Sages sur proposition du Bureau Central.
TITRE IV — RESSOURCES FINANCIÈRES
Article 23 — Ressources Les ressources de l'ADT sont constituées des cotisations de ses membres, des dons, legs et subventions qu'elle pourrait recevoir, ainsi que du produit de ses activités.
Article 24 — Collecte et validation des dépenses Le Bureau Central est habilité à collecter les cotisations des membres. Toutefois, toute dépense et tout projet doivent être validés par le Conseil des Sages avant exécution.
Article 25 — Compte bancaire Un compte bancaire est ouvert au nom de l'Association de la Diaspora Tchadienne. Ce compte fonctionne sous la triple signature :
- du Coordinateur du Bureau Central ;
- du Chargé des finances du Bureau Central ;
- du Président du Conseil des Sages.
TITRE V — DISPOSITIONS DIVERSES
Article 26 — Modification des statuts Les présents statuts ne peuvent être modifiés que par l'Assemblée Générale, sur proposition du Conseil des Sages ou du Bureau Central, selon les modalités de quorum et de majorité fixées par le règlement intérieur.
Article 27 — Dissolution La dissolution de l'ADT ne peut être prononcée que par l'Assemblée Générale, dans les conditions fixées par le règlement intérieur. En cas de dissolution, l'actif net de l'Association est dévolu selon les modalités décidées par l'Assemblée Générale, sur proposition du Conseil des Sages.
Article 28 — Règlement intérieur Un règlement intérieur, adopté par l'Assemblée Générale sur proposition du Conseil des Sages, précise et complète les présents statuts.
RÈGLEMENT INTÉRIEUR DE L'ASSOCIATION DE LA DIASPORA TCHADIENNE
CHAPITRE 1 — DE L'ASSEMBLÉE GÉNÉRALE
Article 1 — Convocation L'Assemblée Générale est convoquée par le Bureau Central, en concertation avec le Conseil des Sages, par tout moyen de communication permettant d'informer l'ensemble des membres (plateforme numérique, réseaux sociaux officiels de l'Association, courrier électronique), au moins sept (7) jours avant la date retenue, sauf urgence motivée.
Article 2 — Quorum et votes Les décisions de l'Assemblée Générale sont prises à la majorité simple des membres présents ou représentés, sauf pour la modification des statuts et la dissolution de l'Association, qui requièrent une majorité des deux tiers (2/3).
Article 3 — Déroulement Chaque Assemblée Générale donne lieu à la désignation d'au moins deux rapporteurs (de préférence un francophone et un arabophone), chargés de consigner les débats et les décisions dans un compte rendu transmis aux membres dans un délai raisonnable.
CHAPITRE 2 — DU CONSEIL DES SAGES
Article 4 — Élargissement Toute demande d'élargissement du Conseil des Sages au-delà de ses cinq membres fondateurs, dans la limite de trente membres, est décidée par le Conseil des Sages lui-même, sur proposition de son Président, et présentée pour information à l'Assemblée Générale.
Article 5 — Attributions du Président du Conseil des Sages Le Président du Conseil des Sages :
- convoque et préside les réunions du Conseil ;
- cosigne, avec le Coordinateur et le Chargé des finances du Bureau Central, toute opération sur le compte bancaire de l'Association ;
- rend compte périodiquement de l'action du Conseil devant l'Assemblée Générale, selon le calendrier qu'il détermine.
Toute dépense engagée par le Bureau Central au-delà d'un seuil fixé par le Conseil des Sages, ainsi que tout projet de développement ou d'investissement, doit faire l'objet d'une demande écrite motivée, soumise au Conseil des Sages, qui dispose d'un délai raisonnable pour se prononcer.
Article 7 — Arbitrage et discipline
Le Conseil des Sages est seul compétent pour connaître des différends internes à l'Association, prononcer d'éventuelles sanctions à l'encontre d'un membre ou d'un responsable, et statuer sur toute demande d'exclusion.
CHAPITRE 3 — DU BUREAU CENTRAL
Article 8 — Élargissement du Bureau Central
Toute demande d'élargissement du Bureau Central au-delà de ses cinq membres statutaires est adressée par écrit au Conseil des Sages, qui seul peut la valider, en précisant le poste créé et ses attributions. Cependant, pour le bien de la Diaspora, certains membres du comité provisoire, jugés compétents, pourront intégrer le bureau central après son élection. L’idée est de tirer parti de leur expérience, à condition qu’ils soient certains de pouvoir se rendre disponibles.
Article 9 — Reconnaissance et création des Bureaux exécutifs nationaux
Dans chaque pays où réside une communauté tchadienne organisée, le Bureau Central :
- reconnaît officiellement le Bureau exécutif existant, après vérification de sa représentativité et de son fonctionnement démocratique ;
- en l'absence de tout Bureau exécutif, engage, en lien avec les membres locaux, le processus de création d'un tel Bureau, selon des modalités comparables à celles de l'élection du Bureau Central.
Article 10 — Gestion financière courante
Le Chargé des finances du Bureau Central tient une comptabilité régulière des cotisations perçues et des dépenses engagées, et en rend compte trimestriellement au Conseil des Sages ainsi qu'à l'Assemblée Générale.
CHAPITRE 4 — DES SERVICES SPÉCIALISÉS
Article 11 — Fonctionnement
Chaque Service est placé sous la responsabilité d'un référent désigné par le Bureau Central, avec l'accord du Conseil des Sages. Le référent rend compte régulièrement de l'activité de son Service au Bureau Central.
Article 12 — Création de nouveaux Services
Tout membre ou Bureau exécutif national peut proposer la création d'un nouveau Service, par une demande motivée adressée au Bureau Central, lequel la transmet, avec son avis, au Conseil des Sages pour validation.
Article 13 — Fin de mandat
Le mandat de l'ensemble des responsables de Services prend automatiquement fin à l'échéance du mandat du Bureau Central en exercice. Les nouveaux responsables sont désignés par le Bureau Central nouvellement installé, selon les mêmes modalités.
CHAPITRE 5 — DISPOSITIONS FINANCIÈRES COMPLÉMENTAIRES
Article 14 — Cotisations
Pour devenir membre officiel de la Diaspora, il suffit de payer un droit d’adhésion unique de 10 dollars par virement sur le compte bancaire officiel de la Diaspora. Aucun paiement en espèces n’est accepté. La fréquence annuelle des cotisations est déterminée par le Bureau Central, validée par le Conseil des Sages, puis communiquée à l’Assemblée Générale.
Article 15 — Transparence financière Un rapport financier est présenté par le Bureau Central à chaque Assemblée Générale ordinaire, après validation préalable par le Conseil des Sages.
CHAPITRE 6 — DISPOSITIONS FINALES
Article 16 — Révision du règlement intérieur Le présent règlement intérieur peut être modifié par l'Assemblée Générale, sur proposition du Conseil des Sages ou du Bureau Central, dans les mêmes conditions de majorité que celles prévues pour les décisions ordinaires.
Article 17 — Entrée en vigueur Le présent règlement intérieur entre en vigueur dès son adoption par l'Assemblée Générale et s'impose à tous les membres de l'Association de la Diaspora Tchadienne.
ADTالنظام الأساسي لجمعية الجالية التشادية
الباب الأول — أحكام عامة
المادة 1
التسمية. تُنشأ، بين الأشخاص المنضمين إلى هذا النظام الأساسي، جمعية تحمل اسم جمعية الجالية التشادية، ويُرمز إليها اختصارًا بـ ADT.
المادة 2
الطبيعة. جمعية الجالية التشادية مؤسسة غير حزبية، وغير دينية، وغير قبلية، وغير عشائرية، مفتوحة لكل شخص يحمل الجنسية التشادية أو من أصل تشادي مقيم خارج الإقليم الوطني، دون أي تمييز على أساس الرأي السياسي أو الانتماء الديني أو الأصل الجهوي أو المجتمعي.
المادة 3
الهدف. تهدف الجمعية إلى:
- توحيد صفوف التشاديين والأشخاص من أصل تشادي المقيمين بالخارج ضمن هيكل تمثيلي، ذي مصداقية وشفافية؛
- المساهمة، من خلال كفاءاتها ومواردها وشبكاتها، في التنمية الاقتصادية والاجتماعية والثقافية والإنسانية لتشاد؛
- الدفاع عن المصالح المعنوية والمادية لأعضائها في بلدان إقامتهم؛
- تعزيز السلام والتماسك الاجتماعي والتضامن بين جميع التشاديين، دون أي تمييز.
المقر والانتشار. تهدف الجمعية إلى تنظيم الجالية التشادية في جميع بلدان الإقامة، عبر مكاتب تنفيذية وطنية مرتبطة بهيئة مركزية. يُحدَّد المقر المركزي من قبل المكتب المركزي للجالية التشادية، بموافقة مجلس الحكماء.
المادة 5
المدة. تُؤسَّس الجمعية لمدة غير محددة.
الباب الثاني — الأعضاء
المادة 6
العضوية. يجوز الانضمام إلى الجمعية لكل شخص يحمل الجنسية التشادية أو من أصل تشادي، مقيم خارج تشاد، يقبل دون تحفظ هذا النظام الأساسي واللائحة الداخلية، وتكون اشتراكاته مسددة.
المادة 7
حقوق الأعضاء. لكل عضو الحق في المشاركة في الجمعيات العامة، وأخذ الكلمة وفق الشروط التي تحددها اللائحة الداخلية، والتصويت، والترشح لهيئات الجمعية، والاطلاع على سير إدارة الجمعية.
المادة 8
واجبات الأعضاء. يلتزم كل عضو باحترام هذا النظام الأساسي، وتسديد اشتراكه، ومراعاة الحياد السياسي والديني والقبلي والعشائري للجمعية، والامتناع عن أي سلوك يسيء إلى صورة الجمعية أو وحدتها.
المادة 9
فقدان صفة العضو. تُفقَد صفة العضو بالاستقالة أو الوفاة أو الفصل الذي يقرره مجلس الحكماء في حال الإخلال الجسيم بهذا النظام الأساسي، وفق الشروط التي تحددها اللائحة الداخلية.
الباب الثالث — هيئات الجمعية
تتكون الجمعية من ثلاث هيئات رئيسية: الجمعية العامة، وهي الهيئة صاحبة السيادة؛ مجلس الحكماء للجالية التشادية (CSDT)، وهو الهيئة التشريعية والرقابية؛ المكتب المركزي للجالية التشادية (BCDT)، وهو الهيئة التنفيذية. وتُضاف إلى ذلك المكاتب التنفيذية الوطنية الموجودة في كل بلد إقامة، والمصالح المتخصصة الخاضعة لمسؤولية المكتب المركزي.
الفصل 1 — الجمعية العامة
المادة 10
تضم الجمعية العامة جميع أعضاء الجمعية. وهي الهيئة صاحبة السيادة. تنتخب أو تصادق على تشكيل الهيئات القيادية، وتعتمد وتعدّل النظام الأساسي واللائحة الداخلية، وتبت في أي مسألة يعرضها عليها مجلس الحكماء أو المكتب المركزي.
المادة 11
تُحدَّد طرق الدعوة والنصاب القانوني والتصويت الخاصة بالجمعية العامة في اللائحة الداخلية.
الفصل 2 — مجلس الحكماء (CSDT)
المادة 12
مجلس الحكماء هو الهيئة التشريعية للجمعية. يمارس الرقابة على المكتب المركزي، ويصادق على قراراته المالية الرئيسية ومشاريعه، ويفصل في الخلافات الداخلية، ويسهر على احترام هذا النظام الأساسي والقيم التأسيسية للجمعية.
المادة 13
يتكون مجلس الحكماء، في تشكيلته الأساسية، من خمسة أعضاء: رئيس؛ منسق؛ مكلف بالرقابة ومتابعة الأنشطة والشؤون المالية؛ ناطق رسمي؛ مستشار مكلف بمهمة. ويمكن توسيعه ليصل إلى ثلاثين (30) عضوًا، وفق الطرق التي تحددها اللائحة الداخلية.
المادة 14
عند التشكيل الأولي: يُعيَّن أو يُنتخب رئيس من قبل الجمعية العامة في نفس يوم انتخاب المكتب المركزي؛ ويتولى تشكيل بقية مكتبه بثقة تامة، ويعرضه على مصادقة جمعية عامة يحدد هو تاريخها.
المادة 15
مدة ولاية مجلس الحكماء ثلاث (3) سنوات، قابلة للتجديد مرة واحدة فقط.
الفصل 3 — المكتب المركزي (BCDT)
المادة 16
المكتب المركزي هو الهيئة التنفيذية للجمعية. يُنفذ قرارات الجمعية العامة، ويدير الشؤون الجارية، ويجمع الاشتراكات، وينسق مع المكاتب التنفيذية الوطنية، ويشرف على المصالح المتخصصة.
المادة 17
يتكون المكتب المركزي من خمسة (5) أعضاء: منسق؛ مساعد المنسق؛ مكلف بالشؤون المالية؛ نائب المكلف بالشؤون المالية؛ مكلف بالاتصال. ولا يمكن المصادقة على توسيعه إلا من قبل مجلس الحكماء.
المادة 18
مدة ولاية المكتب المركزي سنتان (2)، قابلة للتجديد مرة واحدة فقط، بموافقة مجلس الحكماء.
المادة 19
يعترف المكتب المركزي بالمكاتب التنفيذية القائمة في بلدان الإقامة، ويحق له المبادرة بإنشائها حيثما لم تكن موجودة بعد.
الفصل 4 — المصالح المتخصصة
المادة 20
ينشئ مجلس الحكماء مصالح متخصصة لتعزيز عمل المكتب المركزي، وتوضع تحت مسؤوليته المباشرة.
المادة 21
تُنشأ على وجه الخصوص: مصلحة اللاجئين؛ المصلحة القانونية؛ مصلحة المشاريع؛ المصلحة الاجتماعية؛ وأي مصلحة أخرى تُعتبر ضرورية.
المادة 22
تنتهي ولاية المصالح بانتهاء ولاية المكتب المركزي القائم.
الباب الرابع — الموارد المالية
المادة 23
تتكون موارد الجمعية من اشتراكات الأعضاء، والهبات والوصايا والإعانات التي قد تتلقاها، وكذلك عائدات أنشطتها.
المادة 24
يجمع المكتب المركزي الاشتراكات. غير أن كل نفقة وكل مشروع يجب أن يصادق عليهما مجلس الحكماء قبل التنفيذ.
المادة 25
يُفتح حساب بنكي باسم الجمعية، يعمل بتوقيع ثلاثي: منسق المكتب المركزي، والمكلف بالشؤون المالية بالمكتب المركزي، ورئيس مجلس الحكماء.
الباب الخامس — أحكام متنوعة
المادة 26
لا يجوز تعديل هذا النظام الأساسي إلا من قبل الجمعية العامة، بناءً على اقتراح مجلس الحكماء أو المكتب المركزي.
المادة 27
لا يجوز حل الجمعية إلا من قبل الجمعية العامة. وتُوزَّع الأصول الصافية وفق الطرق التي تقررها الجمعية العامة، بناءً على اقتراح مجلس الحكماء.
المادة 28
تحدد لائحة داخلية، تعتمدها الجمعية العامة بناءً على اقتراح مجلس الحكماء، تفاصيل هذا النظام الأساسي وتكمله.
اللائحة الداخلية لجمعية الجالية التشادية
الفصل 1 — الجمعية العامة
المادة 1
يدعو المكتب المركزي إلى الجمعية العامة، بالتشاور مع مجلس الحكماء، بأي وسيلة تتيح إعلام جميع الأعضاء، قبل سبعة (7) أيام على الأقل من التاريخ المحدد، إلا في حالة الاستعجال المبرر.
المادة 2
تُتخذ القرارات بالأغلبية البسيطة للأعضاء الحاضرين أو الممثَّلين، باستثناء تعديل النظام الأساسي وحل الجمعية، اللذين يتطلبان أغلبية الثلثين (2/3).
المادة 3
تُعيَّن في كل جمعية عامة مقرران اثنان على الأقل (يُفضَّل أحدهما ناطقًا بالفرنسية والآخر بالعربية)، مكلَّفان بتدوين المحضر.
الفصل 2 — مجلس الحكماء
المادة 4
يُقرر مجلس الحكماء بنفسه، بناءً على اقتراح رئيسه، أي توسيع لتشكيلته، في حدود ثلاثين عضوًا، ويُعرض ذلك على الجمعية العامة للعلم.
المادة 5
يدعو رئيس مجلس الحكماء إلى اجتماعات المجلس ويترأسها، ويوقّع مع منسق المكتب المركزي والمكلف بالشؤون المالية على كل عملية بنكية، ويقدم تقريرًا دوريًا أمام الجمعية العامة.
المادة 6
كل نفقة تتجاوز سقفًا يحدده مجلس الحكماء، وكل مشروع، يجب أن يكون موضوع طلب كتابي مبرر يُعرض على المجلس، الذي يبت فيه خلال مهلة معقولة.
المادة 7
مجلس الحكماء هو الجهة الوحيدة المختصة بالنظر في الخلافات الداخلية، والعقوبات، وطلبات الفصل.
الفصل 3 — المكتب المركزي
المادة 8
يُرسَل كل طلب لتوسيع المكتب المركزي كتابيًا إلى مجلس الحكماء، وهو الجهة الوحيدة المخولة بالمصادقة عليه. غير أنه، لمصلحة الجالية، يمكن لبعض أعضاء اللجنة المؤقتة الذين تثبت كفاءتهم الانضمام إلى المكتب المركزي بعد انتخابه، للاستفادة من خبرتهم، شريطة أن يضمنوا توفرهم.
المادة 9
في كل بلد، يعترف المكتب المركزي بالمكتب التنفيذي القائم بعد التحقق من تمثيليته، أو يبادر بعملية إنشاء مكتب حيثما لا يوجد. ويقدم كل مكتب تنفيذي وطني تقريرًا عن نشاطه إلى المكتب المركزي.
المادة 10
يُمسك المكلف بالشؤون المالية محاسبة منتظمة ويقدم عنها تقريرًا فصليًا إلى مجلس الحكماء والجمعية العامة.
الفصل 4 — المصالح المتخصصة
المادة 11
توضع كل مصلحة تحت مسؤولية مرجع يعينه المكتب المركزي، بموافقة مجلس الحكماء.
المادة 12
يمكن لأي عضو أو مكتب تنفيذي وطني اقتراح إنشاء مصلحة جديدة، تُعرض على المكتب المركزي ثم على مجلس الحكماء للمصادقة.
المادة 13
تنتهي ولاية مسؤولي المصالح بانتهاء ولاية المكتب المركزي القائم.
الفصل 5 — أحكام مالية تكميلية
المادة 14
للحصول على صفة عضو رسمي في الجالية، يكفي دفع رسم انضمام واحد قدره 10 دولارات، عبر تحويل بنكي إلى الحساب الرسمي للجالية. لا يُقبل أي دفع نقدي. يحدد المكتب المركزي وتيرة الاشتراكات السنوية، ويصادق عليها مجلس الحكماء، ثم تُبلَّغ إلى الجمعية العامة.
المادة 15
يقدم المكتب المركزي تقريرًا ماليًا في كل جمعية عامة عادية، بعد مصادقة مسبقة من مجلس الحكماء.
الفصل 6 — أحكام ختامية
المادة 16

Articles of Association of the Chadian Diaspora Association (ADT)
Title I — General Provisions
Art. 1
Name. An association named the Chadian Diaspora Association, abbreviated ADT, is hereby created among the persons adhering to these Articles.
Art. 2
Nature. The ADT is a non-political, non-religious, non-tribal and non-clan-based institution, open to any person of Chadian nationality or origin residing outside national territory, without distinction of political opinion, faith, regional or community origin.
Art. 3
Purpose. The ADT aims to:
- unite Chadians and persons of Chadian origin living abroad around a representative, credible and transparent structure;
- contribute, through its skills, resources and networks, to Chad's economic, social, cultural and human development;
- defend the moral and material interests of its members in their countries of residence;
- promote peace, social cohesion and solidarity among all Chadians, without distinction.
Headquarters and reach. The ADT aims to structure the Chadian diaspora across all countries of residence, through national executive bureaus affiliated with a central body. Its central headquarters shall be set by the Central Bureau, with the Council of Elders' agreement.
Art. 5
Duration. The ADT is established for an unlimited duration.
Title II — Members
Art. 6
Membership. Any person of Chadian nationality or origin, residing outside Chad, who unreservedly accepts these Articles and the Internal Regulations and is up to date with dues, may join the ADT.
Art. 7
Members' rights. Every member has the right to attend General Assemblies, speak under conditions set by the Internal Regulations, vote, stand as a candidate for the Association's bodies, and be informed of the ADT's management.
Art. 8
Members' duties. Every member undertakes to respect these Articles, pay dues, observe the Association's political, religious, tribal and clan neutrality, and refrain from any conduct harming the ADT's image or unity.
Art. 9
Loss of membership. Membership is lost through resignation, death, or expulsion pronounced by the Council of Elders for serious breach of these Articles, under conditions set by the Internal Regulations.
Title III — The Association's Bodies
The ADT is structured around three main bodies: the General Assembly, the sovereign body; the Council of Elders of the Chadian Diaspora (CSDT), the legislative and oversight body; the Central Bureau of the Chadian Diaspora (BCDT), the executive body. These are joined by National Executive Bureaus in each country of residence, and specialized Services under the Central Bureau's responsibility.
Chapter 1 — The General Assembly
Art. 10
The General Assembly brings together all ADT members. It is the Association's sovereign body. It elects or validates the composition of governing bodies, adopts and amends the Articles and Internal Regulations, and rules on any matter submitted by the Council of Elders or the Central Bureau.
Art. 11
The terms for convening, quorum and voting of the General Assembly are set out in the Internal Regulations.
Chapter 2 — The Council of Elders (CSDT)
Art. 12
The Council of Elders is the ADT's legislative body. It oversees the Central Bureau, approves its major financial decisions and projects, arbitrates internal disputes, and ensures compliance with these Articles and the Association's founding values.
Art. 13
In its base form, the Council of Elders comprises five members: a Chair; a Coordinator; an Officer for Control and Monitoring of Activities and Finances; a Spokesperson; an Advisor on Special Assignments. It may be expanded up to thirty (30) members, as set out in the Internal Regulations.
Art. 14
At initial formation: a Chair is appointed or elected by the General Assembly on the same day as the Central Bureau's election; the Chair freely forms the rest of the bureau and submits it for validation at a General Assembly, whose date the Chair sets.
Art. 15
The Council of Elders' term is three (3) years, renewable once.
Chapter 3 — The Central Bureau (BCDT)
Art. 16
The Central Bureau is the ADT's executive body. It implements General Assembly decisions, manages day-to-day affairs, collects dues, coordinates National Executive Bureaus, and oversees specialized Services.
Art. 17
The Central Bureau comprises five (5) members: a Coordinator; an Assistant Coordinator; a Finance Officer; a Deputy Finance Officer; a Communications Officer. Its expansion may only be approved by the Council of Elders.
Art. 18
The Central Bureau's term is two (2) years, renewable once, with the Council of Elders' agreement.
Art. 19
The Central Bureau recognizes existing Executive Bureaus in countries of residence, and is authorized to initiate their creation where none yet exist.
Chapter 4 — Specialized Services
Art. 20
The Council of Elders establishes specialized Services to strengthen the Central Bureau's action, placed under its direct responsibility.
Art. 21
These notably include: the Refugee Service; the Legal Service; the Projects Service; the Social Service; any other Service deemed necessary.
Art. 22
Services' terms end together with the term of the incumbent Central Bureau.
Title IV — Financial Resources
Art. 23
The ADT's resources consist of member dues, any donations, bequests and grants it may receive, and proceeds from its activities.
Art. 24
The Central Bureau collects dues. However, every expense and every project must be approved by the Council of Elders before execution.
Art. 25
A bank account is opened in the ADT's name, operating under triple signature: the Central Bureau Coordinator, the Central Bureau Finance Officer, and the Chair of the Council of Elders.
Title V — Miscellaneous Provisions
Art. 26
These Articles may only be amended by the General Assembly, on a proposal from the Council of Elders or the Central Bureau.
Art. 27
The ADT may only be dissolved by the General Assembly. Net assets shall be allocated as decided by the General Assembly, on a proposal from the Council of Elders.
Art. 28
Internal Regulations, adopted by the General Assembly on a proposal from the Council of Elders, shall detail and supplement these Articles.
Internal Regulations of the ADT
Chapter 1 — The General Assembly
Art. 1
The General Assembly is convened by the Central Bureau, in consultation with the Council of Elders, by any means capable of informing all members, at least seven (7) days before the chosen date, except in a justified emergency.
Art. 2
Decisions are taken by simple majority of members present or represented, except for amendment of the Articles and dissolution, which require a two-thirds (2/3) majority.
Art. 3
Each General Assembly appoints at least two rapporteurs (preferably one French-speaking and one Arabic-speaking), responsible for the minutes.
Chapter 2 — The Council of Elders
Art. 4
Any expansion of the Council of Elders, up to thirty members, is decided by the Council itself, on a proposal from its Chair, and presented to the General Assembly for information.
Art. 5
The Chair of the Council of Elders convenes and chairs Council meetings, co-signs all banking transactions with the Central Bureau's Coordinator and Finance Officer, and reports periodically to the General Assembly.
Art. 6
Any expense beyond a threshold set by the Council of Elders, as well as any project, must be the subject of a reasoned written request submitted to the Council, which shall rule within a reasonable time.
Art. 7
The Council of Elders alone has authority over internal disputes, sanctions, and expulsion requests.
Chapter 3 — The Central Bureau
Art. 8
Any request to expand the Central Bureau is sent in writing to the Council of Elders, the only body authorized to approve it. However, for the Diaspora's benefit, certain members of the provisional committee deemed competent may join the Central Bureau after its election, so as to draw on their experience, provided they can guarantee their availability.
Art. 9
In each country, the Central Bureau recognizes the existing Executive Bureau after verifying its representativeness, or initiates the process of creating one where none exists. Each National Executive Bureau reports its activity to the Central Bureau.
Art. 10
The Finance Officer keeps regular accounts and reports quarterly to the Council of Elders and the General Assembly.
Chapter 4 — Specialized Services
Art. 11
Each Service is placed under the responsibility of a lead appointed by the Central Bureau, with the Council of Elders' agreement.
Art. 12
Any member or National Executive Bureau may propose creating a new Service, submitted to the Central Bureau and then to the Council of Elders for approval.
Art. 13
Service leads' terms end at the expiry of the incumbent Central Bureau's term.
Chapter 5 — Supplementary Financial Provisions
Art. 14
To become an official member of the Diaspora, one need only pay a one-time membership fee of 10 US dollars, by bank transfer to the Diaspora's official account. No cash payment is accepted. The annual frequency of dues is set by the Central Bureau, approved by the Council of Elders, then communicated to the General Assembly.
Art. 15
A financial report is presented by the Central Bureau at each ordinary General Assembly, after prior approval by the Council of Elders.
Chapter 6 — Final Provisions
Art. 16
These Internal Regulations may be amended by the General Assembly, under the same majority conditions as ordinary decisions.
Art. 17
These Internal Regulations take effect upon adoption and are binding on all ADT members.
